- All Board members shall practice the highest degree of confidentiality and integrity.
- Board members shall adhere strictly to all policies of the National Association of the Deaf, particularly this policy of confidentiality.
- Board members shall hold in confidence all print, electronic, digital, and video documents marked “confidential” and/or “for internal use only” unless otherwise specified by the President or the Chief Executive Officer.
- Board members shall refrain from sharing with any person or organization information that has not been made public, unless authorized to do so by the President and/or Chief Executive Officer.
- Board members shall keep confidential all communication and records regarding questions of misconduct by a Board member or Headquarters staff.
- Board members are not permitted during or after their term of office to use information considered confidential by the organization.
- Board members agree to be held accountable for any violation of confidentiality, which is considered a major infraction, and agree to be subjected to penalties for such infractions. The NAD Board of Directors shall determine penalties with guidance from state laws, contract requirements, or other policies. Where necessary, the NAD Board of Directors may seek to obtain evidence of breaches of confidentiality through inquiries, subpoenas, court orders, or any other legal means.
